By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Eligibility and age requirement
The Service is intended for individuals who are at least 17+. By using the Service, you represent that you meet this requirement.
We do not knowingly permit use by children under 13.
2) The Service
Flixcove is your sweet journal for dessert hunts and flavor memories—capture a dessert photo, tag the shop, and save the taste before it fades. You can add photos, shop names, tasting notes, and organize saved shops into a personal collection.
We may add, remove, or modify features, and we may maintain different versions of the Service.
Back to top3) Accounts
3.1 Account creation
Some features may require you to create an account. You agree to provide accurate information (such as name, username, and email) and keep it up to date.
3.2 Account security
You are responsible for safeguarding your account credentials and for activities that occur under your account. Notify us promptly if you suspect unauthorized access.
3.3 Suspension and termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or if necessary to protect the Service, other users, or our rights.
Back to top4) User Content
4.1 Your content
You may create and store content in the Service, including photos, shop details, tasting notes, tags, and other materials (“User Content”).
4.2 Your responsibilities
You are responsible for your User Content and for ensuring you have all necessary rights to upload, store, and share it. Do not upload content that:
- infringes intellectual property or privacy rights,
- is unlawful, harmful, or abusive,
- includes sensitive personal data about others without permission, or
- violates applicable laws or regulations.
4.3 License to operate the Service
You grant Flixcove a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and process your User Content solely to operate, maintain, and improve the Service and to provide features you request.
4.4 Removal of content
You can delete certain User Content within the app (if available). We may remove User Content where we reasonably believe it violates these Terms or the law, or where necessary for safety or technical reasons.
Back to top5) Optional automated/AI-assisted features (if available)
Some optional features may use automated processing (including AI-assisted functionality) to help generate or enhance content (for example, drafting tasting notes or extracting details from a dessert photo). If you choose to use such features:
- You control whether to upload photos/text and whether to save any output.
- Inputs are processed on Flixcove-controlled servers and are not shared with third-party AI model providers.
- Inputs are deleted promptly after processing unless you choose to save results or unless retention is required for security, legal, or support purposes.
For details about data handling (including retention and your rights), refer to the separate privacy policy provided by Flixcove Team.
Back to top6) Acceptable use
You agree not to:
- reverse engineer, decompile, or attempt to extract source code except where permitted by law,
- interfere with or disrupt the Service or its security,
- attempt to access non-public areas of the Service,
- use the Service for illegal activities, or
- misuse the Service in a way that could harm Flixcove or other users.
7) Intellectual property
The Service, including its software, design, and trademarks, is owned by or licensed to Flixcove and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service.
Back to top8) Feedback
If you submit feedback or suggestions, you grant Flixcove the right to use them without restriction or compensation to you, and without any obligation of confidentiality, unless prohibited by law.
Back to top9) Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Flixcove disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or secure.
Back to top10) Limitation of liability
To the fullest extent permitted by law, Flixcove will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising out of or related to your use of the Service.
To the fullest extent permitted by law, Flixcove’s total liability for any claim related to the Service will not exceed the amount you paid to use the Service in the 12 months before the event giving rise to the claim (or, if you paid nothing, USD $10).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
Back to top11) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Flixcove from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service or your violation of these Terms, including your User Content.
Back to top12) Governing law
These Terms are governed by the laws of the jurisdiction where Flixcove Team is primarily established, without regard to conflict of law principles, except where mandatory consumer protection laws apply in your jurisdiction.
Back to top13) Dispute resolution and binding arbitration
13.1 Informal resolution first
Before starting a formal proceeding, you agree to contact us at liltnmit641346@outlook.com and provide a brief description of the dispute and your contact information, and we will try to resolve it informally.
13.2 Binding arbitration
If a dispute cannot be resolved informally, it will be resolved by binding arbitration administered by a recognized arbitration provider, unless prohibited by law. The arbitration will be conducted in English unless otherwise required by applicable law.
13.3 Individual basis; no class actions
To the extent permitted by law, disputes will be brought only on an individual basis and not as a class, consolidated, or representative action.
13.4 Exceptions
Nothing in this section prevents either party from seeking injunctive or equitable relief for unauthorized use of intellectual property or for security-related harm, or from bringing a claim in small claims court where permitted.
Back to top14) Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice within the Service or by other appropriate means. The Effective Date above indicates when these Terms last took effect.
